(وَقَرَارُهُ) أَيْ الضَّمَانِ (مَعَهَا) أَيْ: الْجِنَايَةِ إنْ سَقَطَ بِهَا (عَلَى الْجَانِي) ; لِأَنَّهُ الْمُتْلِفُ لَهُ،
