(فَإِنْ لَمْ يَحْلِفْ حَتَّى أُخِذَتْ) مِنْهُ (ضَمِنَهَا) لِتَفْرِيطِهِ بِتَرْكِ الْحَلِفِ، كَمَا لَوْ سَلَّمَهَا إلَى غَيْرِ رَبِّهَا ظَانًّا أَنَّهُ هُوَ فَتَبَيَّنَ خَطَؤُهُ،
