(وَتَصِحُّ) الْوَصِيَّةُ (بِرَقَبَتِهِ) أَيْ الْمُكَاتَبِ (لِشَخْصٍ و) الْوَصِيَّةُ (لِآخَرَ بِمَا عَلَيْهِ) لِأَنَّ كُلًّا مِنْ الرَّقَبَةِ وَالدَّيْنِ مَمْلُوكٌ لِمُوصٍ
