(وَلِ) لْمُكَاتَبِ (غَيْرِ الْمَحْجُورِ عَلَيْهِ تَقْدِيمُ أَيِّ دَيْنٍ شَاءَ) مِنْ دَيْنِ كِتَابَةٍ وَمُعَامَلَةٍ وَأَرْشِ جِنَايَةٍ كَالْحُرِّ.

[فَصْلٌ وَالْكِتَابَةُ الصَّحِيحَةُ عَقْدٌ لَازِمٌ] مِنْ الطَّرَفَيْنِ لِأَنَّهَا بَيْعٌ
