(فَإِنْ مَاتَ) مُكَاتَبٌ (قَبْلَهُ) أَيْ الْوَفَاءِ (انْفَسَخَتْ) وَلَوْ مَلَكَ وَفَاءً لِأَنَّهُ مَاتَ رَقِيقًا فَمَالُهُ جَمِيعُهُ لِسَيِّدِهِ

(فإن مات) مكاتب ملك وفاء (قبله) أي: قبل أدائه: (انفسخت) كتابته على الأصح؛ لأنه إذا مات قبل الأداء فقد مات رقيقا فيكون ماله جميعه لسيده.
