[فَصْلٌ وَاسْتِبْرَاءُ حَامِلٍ بِوَضْعِ مَا تَنْقَضِي بِهِ الْعِدَّةُ] (وَ) اسْتِبْرَاءُ (مَنْ تَحِيضُ بِحَيْضَةٍ) تَامَّةٍ لِحَدِيثِ " «لَا تُوطَأُ حَامِلٌ حَتَّى تَضَعَ، وَلَا غَيْرُ حَامِلٍ حَتَّى تَحِيضَ حَيْضَةً» " وَ (لَا) يَحْصُلُ اسْتِبْرَاءٌ بِ (بَقِيَّتِهَا) أَيْ الْحَيْضَةِ إذَا مَلَكَهَا حَائِضًا لِلْخَبَرِ
