(ولم تسع لغريم) لرواية الشيباني (أمر عليه الصلاة والسلام بعتق أمهات الأولاد وأن لا يبعن في دين ولا يجعلن من الثلث) أي: حكم ودل قوله ولا يبعن على انتفاء المالية وإذا انعدمت لم يبق عليها سعاية ونكر الدين نفيا للسعاية للغرماء والورثة وقوله ولا يجعلن من الثلث تأكيد لأنه يفهم من قوله وأن لا يبعن في دين كذا في (العناية) ومنعه في (الحواشي السعدية) فإن المدبر لا يباع في دين ويجعل من الثلث
