البحر الرائقIbn Nujaym

(وَيَهْلِكُ مَجَّانًا) أَيْ إذَا هَلَكَ النَّمَاءُ يَهْلِكُ مَجَّانًا بِغَيْرِ شَيْءٍ؛ لِأَنَّ الْأَتْبَاعَ لَا قِسْطَ لَهَا مِمَّا يَتَقَابَلُ بِالْأَصْلِ؛ لِأَنَّهَا لَمْ تَدْخُلْ تَحْتَ الْعَقْدِ مَقْصُودًا.

قَالَ - رَحِمَهُ اللَّهُ -
