(وَ) إنْ حَلَفَ (لَا مِلْكَ لَهُ لَمْ يَحْنَثْ بِدَيْنٍ) لَهُ، لِاخْتِصَاصِ الْمِلْكِ بِالْأَعْيَانِ الْمَالِيَّةِ، وَالدَّيْنُ إنَّمَا يَتَعَيَّنُ الْمِلْكُ فِيمَا يَقْبِضُهُ مِنْهُ.
