(فَلَوْ مَاتَ) مَنْ تَلْزَمُهُ إزَالَتُهُ لِعَدَمِ خَوْفِ الضَّرَرِ (إذَنْ) أَيْ: قَبْلَ إزَالَتِهِ (أُزِيلَ) وُجُوبًا (إلَّا مَعَ مُثْلَةٍ) بِإِزَالَتِهِ، فَلَا تَلْزَمُ إزَالَتُهُ،؛ لِأَنَّهُ يُؤْذِي الْمَيِّتَ مَا يُؤْذِي الْحَيَّ
