(بِخِلَافِ مُجْتَهِدٍ نَكَحَ) امْرَأَةً بِعَقْدٍ أَدَّاهُ اجْتِهَادُهُ إلَى صِحَّتِهِ (ثُمَّ رَأَى بُطْلَانَهُ) ؛ أَيْ: أَدَّاهُ الِاجْتِهَادُ إلَى بُطْلَانِ النِّكَاحِ؛ فَيَلْزَمُهُ فِرَاقُ زَوْجَتِهِ؛ لِاعْتِقَادِهِ تَحْرِيمَ وَطْئِهَا
