وَإذَا قَال لَهُ عَلَيَّ مِنْ ثَمَنِ خَمرٍ أَلفٌ لَم يَلزَمهُ

(وَإِذَا قَالَ مُكَلَّفٌ) مُخْتَارٌ (لَهُ) ؛ أَيْ: فُلَانٍ (عَلَيَّ مِنْ ثَمَنِ خَمْرٍ أَلْفٌ لَمْ يَلْزَمْهُ) شَيْءٌ؛ لِأَنَّهُ أَقَرَّ بِثَمَنِ خَمْرٍ وَقَدَّرَهُ بِأَلْفٍ، وَثَمَنُ الْخَمْرِ لَا يَجِبُ، وَلَوْ قَالَ
