وَقَوْلُهُ: (وَلَا تَصِحُّ وَصِيَّةٌ بِهِ) ؛ لِمَا فِيهِ مِنْ الْإِضْرَارِ بِغَيْرِ الْمُكَلَّفِ فِيهِ مَا فِيهِ؛ لِأَنَّهُ لَا يُمْتَنَعُ عَلَيْهِ الْوَصِيَّةُ لِفَاسِقٍ مَعَ أَنَّهُ قَدْ يَسْتَعِينُ بِهَا عَلَى الْمَعْصِيَةِ.
