(وَحَيٌّ مُضْطَرٌّ لِكَفَنِ مَيِّتٍ مِنْ نَحْوِ بَرْدٍ) مُزْعِجٍ أَوْ حَرٍّ (أَحَقُّ بِهِ) ، أَيْ: كَفَنِ الْمَيِّتِ، فَيَأْخُذُهُ (بِثَمَنِهِ) ؛ لِأَنَّ حُرْمَةَ الْحَيِّ آكَدُ.
