(وَيَتَّجِهُ وَلَا) يَجِبُ عَلَيْهِ أَنْ (يَقْضِيَ) مُتَمَتِّعٌ كَانَ وَطِئَ قَبْلَ حِلِّهِ مِنْ عُمْرَتِهِ (تَطَوُّعًا) مِنْ حَجٍّ وَعُمْرَةٍ فِي هَذِهِ الصُّورَةِ (لِلشَّكِّ) فِي وُقُوعِهِ صَحِيحًا أَوْ فَاسِدًا، - وَالْأَصْلُ صِحَّتُهُ وَالْبَرَاءَةُ مِنْهُ (وَ) لَكِنَّ (الِاحْتِيَاطَ الْقَضَاءُ) لِيَبْرَأَ مِنْهُ بِيَقِينٍ، وَهُوَ مُتَّجِهٌ،
