وَلَا بَيعُ عَطَاءٍ قَبْلَ قَبْضِهِ أَو رُقْعَةٍ بِهِ،

مطالب أولي النهىal-Ruhaybani

(وَلَا) يَصِحُّ (بَيْعُ عَطَاءٍ) : وَهُوَ قِسْطُهُ مِنْ الدِّيوَانِ (قَبْلَ قَبْضِهِ) ؛ لِأَنَّهُ مَغِيبٌ، فَيَكُونُ مِنْ بَيْعِ الْغَرَرِ، (أَوْ) ؛ أَيْ: وَلَا بَيْعُ (رُقْعَةٍ بِهِ) ؛ أَيْ: الْعَطَاءِ؛ لِأَنَّ الْمَقْصُودَ بَيْعُ الْعَطَاءِ دُونَهَا.
