(وَيَتَّجِهُ: لَوْ بَاعَهُ) ؛ أَيْ: الْمَقْبُوضَ بِعَقْدٍ فَاسِدٍ (قَابِضُهُ لِآخَرَ، فَلِمَالِكِ) رَقَبَةٍ (مُطَالَبَةُ كُلٍّ مِنْهُمَا بِهِ) إنْ كَانَ بَاقِيًا، (وَ) إنْ تَلِفَ فَ (قَرَارُ ضَمَانٍ عَلَى تَالِفٍ عِنْدَهُ) مِنْهُمَا.
