مطالب أولي النهىal-Ruhaybani

(عَلَى خِيَارِهِ إذَا أَفَاقَ) مِنْ جُنُونِهِ، (وَلَا يَثْبُتُ) الْخِيَارُ (لِوَلِيِّهِ) عَلَى الصَّحِيحِ مِنْ الْمَذْهَبِ.

جَزَمَ بِهِ فِي " الْمُسْتَوْعِبِ "" وَالتَّلْخِيصِ "" وَالْحَاوِيَيْنِ " وَغَيْرِهِمْ؛ لِأَنَّ الرَّغْبَةَ فِي الْمَبِيعِ وَعَدَمَهَا لَا تُعْلَمُ إلَّا مِنْ جِهَتِهِ.
