مطالب أولي النهىal-Ruhaybani

(وَلَا يَفْتَقِرُ فَسْخُ مَنْ يَمْلِكُهُ) مِنْ الْمُتَعَاقِدَيْنِ (لِحُضُورِ صَاحِبِهِ) الْعَاقِدِ مَعَهُ، (وَلَا) إلَى (رِضَاهُ) .

هَذَا الْمَذْهَبُ، وَعَلَيْهِ جَمَاهِيرُ الْأَصْحَابِ؛ لِأَنَّ الْفَسْخَ حَلَّ عَقْدٌ جُعِلَ إلَيْهِ؛ فَجَازَ فِي غَيْبَةِ صَاحِبِهِ، وَمَعَ سَخَطِهِ؛ كَالطَّلَاقِ.
