وَمَا بَاعَهُ اثْنَانِ مُرَابَحَةً، فَثَمَنُهُ بِحَسَبِ مِلْكِيَّتِهَا لَا عَلَى رَأْسِ مَاليهِمَا،

(وَمَا بَاعَهُ اثْنَانِ) مِنْ عَقَارٍ وَغَيْرِهِ؛ لِأَنَّهُ مُشْتَرَكٌ بَيْنَهُمَا (مُرَابَحَةً، فَثَمَنُهُ) بَيْنَهُمَا (بِحَسَبِ مِلْكِيَّتِهَا) ، كَمُسَاوَمَةٍ، و (لَا) يَكُونُ ثَمَنُهُ (عَلَى رَأْسِ مَالَيْهِمَا) . هَذَا الْمَذْهَبُ، وَقَطَعَ بِهِ الْأَكْثَرُ؛ لِأَنَّ الثَّمَنَ عِوَضُ الْمَبِيعِ فَهُوَ عَلَى قَدْرِ مِلْكَيْهِمَا،
