وَيُخَيَّرُ مُشْتَرٍ إنْ بَقِيَ شَيءٌ ، بَينَ أَخْذِهِ بِقِسْطِهِ مِنْ الثَّمَنِ، أَوْ رَدِّهِ كَمَا لَوْ تَعَيَّبَ بِلَا فِعْلٍ،

(وَيُخَيَّرُ مُشْتَرٍ إنْ) تَلِفَ بَعْضُهُ و (بَقِيَ) مِنْهُ (شَيْءٌ، بَيْنَ أَخْذِهِ) ، أَيْ: الْبَاقِي (بِقِسْطِهِ مِنْ الثَّمَنِ، أَوْ رَدِّهِ) وَأَخْذِ الثَّمَنِ كُلِّهِ، لِتَفْرِيقِ الصَّفْقَةِ، (كَمَا لَوْ تَعَيَّبَ) عِنْدَ الْبَائِعِ (بِلَا فِعْلِ) آدَمِيٍّ، كَمَا تَقَدَّمَ فِي خِيَارِ الْعَيْبِ.
