مطالب أولي النهىal-Ruhaybani

(مِنْ ضَمَانِ مُشْتَرٍ) - وَلَوْ قَبْلَ قَبْضِهِ - (لِحَدِيثِ «الْخَرَاجُ بِالضَّمَانِ» ) . وَهَذَا الْمَبِيعُ رِبْحُهُ لِلْمُشْتَرِي، فَضَمَانُهُ عَلَيْهِ، (إلَّا إنْ مَنْعَهُ) ، أَيْ: الْمُشْتَرِيَ (بَائِعٌ مِنْ قَبْضِهِ) - وَلَوْ لِقَبْضِ ثَمَنِهِ - فَعَلَيْهِ ضَمَانُهُ؛ لِأَنَّهُ كَغَاصِبٍ.
