(وَإِنْ تَلَفَ) رَهْنٌ مُعَارٍ أَوْ مُؤَجَّرٌ بِتَفْرِيطِهِ؛ ضَمِنَهُ رَاهِنٌ بِبَدَلِهِ، وَبِلَا تَفْرِيطٍ؛ (ضَمِنَ رَاهِنٌ لَا مُرْتَهِنٌ الْمُعَارَ، لَا الْمُؤَجَّرَ) ؛ لِأَنَّ الْعَارِيَّةَ مَضْمُونَةٌ وَالْمُؤَجَّرَ أَمَانَةٌ لَا تُضْمَنُ إلَّا بِالتَّعَدِّي أَوْ التَّفْرِيطِ.
