مطالب أولي النهىal-Ruhaybani

(وَلَيْسَ لِوَرَثَةِ رَاهِنٍ مَاتَ إقْبَاضُهُ) ؛ أَيْ: الرَّهْنِ، (وَثَمَّ غَرِيمٌ) لِمَيِّتٍ (لَمْ يَأْذَنْ) فِيهِ نَصًّا؛ لِأَنَّهُ تَخْصِيصٌ لَهُ بِرَهْنٍ لَمْ يَلْزَمْ، وَسَوَاءٌ مَاتَ أَوْ جُنَّ وَنَحْوُهُ قَبْلَ الْإِذْنِ أَوْ بَعْدَهُ؛ لِبُطْلَانِ الْإِذْنِ بِهِمَا.
