مطالب أولي النهىal-Ruhaybani

(وَيَتَّجِهُ وَكَذَا) حُكْمُ (مَحْجُورٍ عَلَيْهِ لِفَلَسٍ) ؛ أَيْ: إذَا عَقَدَ الرَّهْنَ، ثُمَّ حُجِرَ عَلَيْهِ قَبْلَ إقْبَاضِهِ الرَّهْنَ، فَلَيْسَ لَلْمُرْتَهِنِ قَبْضُ الرَّهْنِ إلَّا بِإِذْنِ حَاكِمٍ؛ لِتَعَلُّقِ حَقِّ الْغُرَمَاءِ بِهِ. وَهُوَ مُتَّجِهٌ.
