(وَكَذَا لَوْ جَنَى) رَهْنٌ (عَلَى سَيِّدِهِ فَاقْتَصَّ هُوَ) ؛ أَيْ: السَّيِّدُ، (أَوْ) اقْتَصَّ مِنْهُ (وَارِثُهُ) ، فَعَلَيْهِ قِيمَتُهُ أَوْ أَرْشُهُ يُجْعَلُ رَهْنًا إنْ لَمْ يَأْذَنْ مُرْتَهِنٌ،
