(وَفِي رِوَايَةٍ) عَلَى السَّيِّدِ (قِيمَةُ الرَّهْنِ أَوْ أَرْشُهُ) الْوَاجِبُ بِالْجِنَايَةِ تُجْعَلُ رَهْنًا؛ لِأَنَّهُمَا بَدَلُ مَا فَاتَ عَلَى مُرْتَهِنٍ،
