(الثَّانِي) الْحَجْرُ عَلَى الشِّقْصِ (لِحَظِّ نَفْسِهِ) ؛ كَالْحَجْرِ (عَلَى صَغِيرٍ وَمَجْنُونٍ وَسَفِيهٍ) ؛ لِأَنَّ مَصْلَحَتَهُ عَائِدَةٌ إلَيْهِمْ، وَالْحَجْرُ عَلَيْهِمْ عَامٌّ فِي أَمْوَالِهِمْ وَذِمَمِهِمْ،
