(وَيَتَّجِهُ لَوْ تَلِفَ) مَا ثَمَنُهُ مُؤَجَّلٌ (قَبْلَ) حُلُولِ أَجَلِهِ (فَمِنْ) ضَمَانِ (مُفْلِسٍ) ، وَهَذَا مَفْهُومُ مَنْصُوصِ الْإِمَامِ حَيْثُ قَالَ: يَكُونُ مَالُهُ مَوْقُوفًا إلَى أَنْ يَحُلَّ دَيْنُهُ، فَيَخْتَارُ الْفَسْخَ أَوْ التَّرْكَ. وَهُوَ مُتَّجِهٌ.
