وَلَا يَحِلُّ مُؤَجَّلٌ بِجُنُونٍ أَوْ بِمَوْتٍ إنْ وُثِّقَ وَرَثَتُهُ.

مطالب أولي النهىal-Ruhaybani

(وَلَا يَحِلُّ) دَيْنٌ (مُؤَجَّلٌ بِجُنُونٍ) كَإِغْمَاءٍ (أَوْ) ؛ أَيْ: وَلَا يَحِلُّ (بِمَوْتٍ) ؛ لِحَدِيثِ:«مَنْ تَرَكَ حَقًّا أَوْ مَالًا فَلِوَرَثَتِهِ» .

وَالْأَجَلُ حَقٌّ لِلْمَيِّتِ، فَيُنْقَلُ لِوَرَثَتِهِ (إنْ وُثِّقَ وَرَثَةُ) رَبِّ الدَّيْنِ.
