وَلَيسَ لِضَامِنٍ مَاتَ مَضْمُونُهُ مُطَالبَةُ رَبِّ حَقٍّ بِقَبْضِهِ مِنْ تَرِكَةِ مَضمُونِهِ أَوْ يُبْرِئَهُ،

مطالب أولي النهىal-Ruhaybani

(وَلَيْسَ لِضَامِنٍ إذَا مَاتَ مَضْمُونُهُ مُطَالَبَةُ رَبِّ حَقٍّ بِقَبْضِهِ) ؛ أَيْ: الدَّيْنِ الْمَضْمُونِ فِيهِ (مِنْ تَرِكَةِ مَضْمُونِهِ) لِيَبْرَأَ الضَّامِنُ، (أَوْ أَنْ يُبْرِئَهُ) ؛ أَيْ: الضَّامِنُ مِنْ الضَّمَانِ؛ كَمَا لَوْ لَمْ يَمُتْ الْأَصِيلُ.
