مطالب أولي النهىal-Ruhaybani

(وَلِوَلِيٍّ تَزْوِيجُ سَفِيهٍ) لَيْسَ مِنْ عَادَتِهِ الطَّلَاقُ (بِلَا إذْنِهِ) مَعَ سُكُوتِهِ (لِحَاجَةٍ) ؛ لِمَا تَقَدَّمَ. (وَ) لَهُ (إجْبَارُهُ) ؛ أَيْ: السَّفِيهِ عَلَى النِّكَاحِ إنْ امْتَنَعَ مِنْهُ (لِمَصْلَحَةٍ) ؛ كَإِجْبَارِهِ عَلَى غَيْرِهِ مِنْ الْمَصَالِحِ، (وَكَسَفِيهَةٍ) فَلِوَلِيِّهَا إجْبَارُهَا عَلَى النِّكَاحِ لِمَصْلَحَتِهَا.
