(وَلَا يُعَامَلُ صَغِيرٌ) لَمْ يُعْلَمْ الْإِذْنُ لَهُ (إلَّا فِي مِثْلِ مَا يُعَامِلُهُ فِيهِ،

وَلَا يَصِحُّ تَبَرُّعُ مَأْذُونٍ لَهُ بِدَرَاهِمَ وَكِسْوَةٍ وَنَحْوِهِمَا) ؛ كَفَرَسٍ وَحِمَارٍ؛ لِأَنَّهُ لَيْسَ مِنْ التِّجَارَةِ وَلَا يَحْتَاجُ إلَيْهِ، فَلَا يَتَنَاوَلُهُ الْإِذْنُ؛ كَغَيْرِ الْمَأْذُونِ لَهُ.
