(أَوْ) تَعَذَّرَ الْمَاءُ، (لِعَدَمِ بَذْلِهِ إلَّا بِزِيَادَةٍ كَثِيرَةٍ عَادَةً عَلَى ثَمَنِ مِثْلِهِ فِي مَكَانِهِ) ؛ لِأَنَّ عَلَيْهِ ضَرَرًا فِي دَفْعِ الزِّيَادَةِ الْكَثِيرَةِ فَلَمْ يَلْزَمْهُ تَحَمُّلُهُ، كَضَرَرِ النَّفْسِ
