مطالب أولي النهىal-Ruhaybani

(عَدِمَاهَا) - أَيْ: الْبَيِّنَةَ - وَهُوَ بِيَدِ أَحَدِهِمَا؛ فَاللَّقِيطُ (لِذِي الْيَدِ) ؛ لِأَنَّ الْيَدَ تُفِيدُ الْمِلْكَ، فَأَوْلَى أَنْ تُفِيدَ الِاخْتِصَاصَ (بِيَمِينِهِ) ؛ لِاحْتِمَالِ صِدْقِ الْآخَرِ.
