مطالب أولي النهىal-Ruhaybani

(فَإِنْ كَانَ) اللَّقِيطُ (بِيَدَيْهِمَا) ، وَلَا بَيِّنَةَ؛ (أُقْرِعَ) بَيْنَهُمَا؛ لِتَسَاوِيهِمَا فِي السَّبَبِ وَعَدَمِ الْمُرَجِّحِ، وَلَا سَبِيلَ إلَى اشْتِرَاكِهِمَا فِي كَفَالَةِ اللَّقِيطِ، كَمَا تَقَدَّمَ [ (فَمَنْ قَرَعَ) - أَيْ: خَرَجَتْ الْقُرْعَةُ لَهُ - (سُلِّمَ) اللَّقِيطُ (إلَيْهِ بِيَمِينِهِ) لِمَا تَقَدَّمَ] .
