وإنْ وَصَّى أَو وَهَبَ لَهُ؛ قَبِلَا

مطالب أولي النهىal-Ruhaybani
(وَإِنْ وَصَّى) أَيْ: الْمُلْحَقُ بِاثْنَيْنِ؛ قَبِلَا لَهُ الْوَصِيَّةَ (أَوْ وَهَبَ لَهُ؛ قَبِلَا) لَهُ الْهِبَةَ؛ لِأَنَّهُمَا بِمَنْزِلَةِ أَبٍ وَاحِدٍ.
وَعَلَى قِيَاسِ ذَلِكَ سَائِرُ التَّصَرُّفَاتِ مِنْ نِكَاحٍ أَوْ غَيْرِهِ قَالَ الْمُوَضِّحُ: وَهُمَا وَلِيَّانِ فِي غَيْرِ ذَلِكَ كَنِكَاحٍ وَغَيْرِهِ.
