مطالب أولي النهىal-Ruhaybani

(وَجِنَايَةُ مَا) - أَيْ: مَوْقُوفٍ - (عَلَى غَيْرِ آدَمِيٍّ مُعَيَّنٍ) ؛ كَعَبْدٍ مَوْقُوفٍ عَلَى مَسْجِدٍ أَوْ عَلَى الْمَسَاكِينِ؛ إذَا جَنَى فَأَرْشُ جِنَايَتِهِ (فِي كَسْبِهِ) ؛ لِأَنَّهُ لَيْسَ لَهُ مُسْتَحِقٌّ مُعَيَّنٌ يُمْكِنُ إيجَابُ الْأَرْشِ عَلَيْهِ، وَلَا يُمْكِنُ تَعَلُّقُهَا فِي رَقَبَتِهِ؛ فَتَعَيَّنَ فِي كَسْبِهِ.
