مطالب أولي النهىal-Ruhaybani

(وَلَا يَطَؤُهَا) - أَيْ: الْأَمَةَ الْمَوْقُوفَةَ - (وَلَوْ أَذِنَ) فِي وَطِئَهَا (وَاقِفٌ) ؛ لِأَنَّ مِلْكَهُ نَاقِصٌ، وَلَا يُمْكِنُ مَنْعُ حَبَلِهَا، فَتَنْقُصُ أَوْ تَتْلَفُ، أَوْ تَخْرُجُ مِنْ الْوَقْفِ بِأَنْ تَبْقَى أُمَّ وَلَدٍ.
