لَا إنْ قَالَ الْمَرِيضُ لِابْنِ عَمِّهِ وَنَحْوِهِ: (أَنْتَ حُرٌّ بَعْدَ مَوْتِي، أَوْ) قَالَ لَهُ: أَنْتَ حُرٌّ (مَعَهُ) - أَيْ: مَعَ مَوْتِي؛ لَمْ يَرِثْ لِمُقَارَنَةِ الْحُرِّيَّةِ الْإِرْثَ، وَعَدَمِ سَبْقِهَا لَهُ.
