"ومن أخرج ظبية من الحرم فولدت أولادا فماتت هي وأولادها فعليه جزاؤهن" لأن الصيد بعد الإخراج من الحرم بقي مستحقا للأمن شرعا ولهذا وجب رده إلى مأمنه وهذه صفة شرعية فتسرى إلى الولد
