"والنسب يثبت من الزوج" لأن الفراش له وإن كان النكاح فاسدا إذ الفاسد ملحق بالصحيح في حق الأحكام ولو ادعاه المولى لا يثبت نسبه منه لأنه ثابت النسب من غيره ويعتق الولد وتصير أمه أم ولد له لإقراره
