"وإن سمى لها مهرا جاز منه مقدار مهر مثلها" لأنه من ضرورات النكاح "وبطل الفضل" لأنه لا ضرورة فيه، وهذا التزام بالتسمية ولا نظر له فيه فلم تصح الزيادة وصار كالمريض مرض الموت
