قال: "وإذا اقتسم الشركاء العقار فلا شفعة لجارهم بالقسمة" لأن القسمة فيها معنى الإفراز ولهذا يجري فيها الجبر؛ والشفعة ما شرعت إلا في المبادلة المطلقة.
