قال: "وإذا اشترى دارا فسلم الشفيع الشفعة ثم ردها المشتري بخيار رؤية أو شرط أو بعيب بقضاء قاض فلا شفعة للشفيع" لأنه فسخ من كل وجه فعاد إلى قديم ملكه والشفعة في إنشاء العقد، ولا فرق في هذا بين القبض وعدمه.
