"ولو عين قدرا لا يجوز للمستعير أن يرهنه بأكثر منه، ولا بأقل منه" ؛ لأن التقييد مفيد، وهو ينفي الزيادة؛ لأن غرضه الاحتباس بما تيسر أداؤه، وينفي النقصان أيضا؛ لأن غرضه أن يصير مستوفيا للأكثر بمقابلته عند الهلاك ليرجع به عليه
