(وإن أتلفه) أي: ما ذكر من الثمر (آدميٌّ معيَّنٌ، أو) أتلفه (عسكرٌ ولُصوص، خُيِّر مشترٍ بين فسخ) البيع، ويرجع بما دفعه (و) بين (إمضاءٍ ومطالبةِ مُتلِفٍ) بالبدل، كالمكيل اذا أتلفه آدمي قبل القبض.
