(وإن تلف الجميع) أي: جميع المبيع من الثمرة (بالجائحة، بطل العقد) فلا تخيير للمشتري (ويرجع المشتري بجميع الثمن) على البائع إن كان دفعه له، وإلا سقط عنه، لما تقدم من حديث جابر .
