(ولا يملك المقرِض استرجاعه) أي: القرض؛ للزومه من جهته بالقبض (ما لم يفلس القابض، وبُحْجَر عليه) للفَلَس قبل أخذ شيء من بدله، فله الرجوع به، كما يأتي في الحَجْر.
