(وله) أي: للمقرِض (طلبُ بدلِهِ) أي: القرض (في الحال) مطلقًا؛ لأن القرض يثبت في الذمة حالاًّ، فكان له طلبه كسائر الديون الحالة، ولأنه سبب يوجب رَدَّ المِثْل أو القيمة، فكان حالاًّ كالإتلاف.
